Respected Madam,

Association intends to bring to your kind notice certain issues concerning
under Rule-38 transfer orders in the Inspector Posts cadre. Transfer case of
Smt. Kavita A., SDI (P) Mangalore South Sub Division was discussed with your
honour during the course of meeting held on 6/2/2013 and it was assured that
the said case will be decided early. While admitting that transfer/posting is
administrative privilege, but it is also fact that DOPT guidelines coupled with
Directorate instructions contained in
letter No. A-34013/01/2009-DE/SPB-II dated 05/02/2010 for consideration of
request of lady Inspectors Posts for transfer to home circle /circle of their
choice / place of posting of their spouse are not being taken into
consideration while deciding such issues. Though it is clear in said
instruction that, the transfer of lady inspectors can be allowed under Rule 38
of P&T Volume-IV without provision of minimum service in the grade of
Inspectors of Posts yet this has not considered in Karnataka Circle.
Transfer
case of Smt. Kavitha A., SDI (P), Mangalore South Sub Division to her parent
Kerala Circle despite having consent
under letter No. ST/4-1/2011 dated 20/6/2012 (copy enclosed) is the set
example of discrimination. Madam, more than one year’s period have already been
elapsed from receipt of consent from Kerala Circle, but justice is denied in
this case only on the reason of acute shortage of IPs in Karnataka Circle. We
would like to further bring to your kind notice that, her junior’s requests for
transfer from Karnataka to Kerala Circle have been considered in 2012 only.
Consent given by other Circles to adjust the incumbents, circumstances under
which IPs/ASPs are working in the circles has no meaning in as such. Even the
humanitarian grounds are not being considered while deciding such genuine
issues.
Such
type of instances not only cause hardship for the cadre but also demoralizes
them thereby effecting business and work of the administration. Madam, you will
agree that IPs/ASPs working at farther places from their home, having language
problems always face difficulties resulting in frustrations. Moreover lady staff could not discharge
their duties to the entire satisfaction of administration particularly when she
is far from their families. The sense of responsibility grows even greater when
a spouse is weighed down by problems with job, family, kids, health, or social
obligations or is coping with feelings of loss, disappointment, and fear at far
flung places like Smt. Kavitha.
It is therefore requested your
honour to kindly look the matter personally and issue directions to CPMG,
Karnataka Circle to relive the official immediately to Kerala Circle.
