CAT, Hyderabad orders for Grade pay of Rs.5400 to ACP Inspectors


It’s been a long slow battle for Inspectors of Customs and Central Excise who have been granted non-functional upgradation under Assured Career Progression Scheme (ACP) to the grade of Superintendent of Customs and Central Excise prior to 1.9.2008, to get the grade pay of Rs.5400 after completion of 4 years of service in the pay scale of Rs.7500-12000 (pre-revised).

Division Bench of Hon’ble Madras High Court in W.P.No: 13225/2010 has given a categorical order in this matter to the effect that the petitioner Inspector of Central Excise who was granted ACP to the grade of Superintendent and completed 4 years in the pay scale of Rs.7500-12000 as on 01.01.2008 is entitled to grade pay of Rs.Rs.5400. This High Court Order has been challenged by Government in the form of a Civil Appeal before Hon’ble Supreme Court which is pending before the Apex Court. However, no stay was granted by the Apex Court.

Now in line with the High Court Order, Central Administrative Tribunal (CAT), Hyderabad Bench in O.A.1051 of 2010 has ordered on 30.03.2012 that the applicants (Inspectors) shall be granted higher grade pay of Rs.5400 with effect from their respective dates of completion of 4 years of service in the grade pay of Rs.4800/- (Pre-revised scale of Rs.7500-12000
